Our Terms of Service.Know the rules before you begin.

You agree to use the website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of the website by, any third party.

The scope, price and schedule of each project are set out in the quote we agree with you. Up to two rounds of revisions are included during development; further changes, and any work outside the agreed scope, are quoted before we begin. You supply your logo, text and other content, and the schedule depends on receiving them on time.

The build fee is charged once. Hosting and management plans, domain registration and renewal, and optional services are billed separately. Prices published on this website may change, but a change does not affect a quote you have already accepted or a term you have already paid for.

The Fully Managed + Hosting plan has a minimum term of one year and renews for further one-year terms. We will email you before each renewal, and you can stop the renewal by telling us before the renewal date. Fees for a term that has already started are not refunded, except as these Terms or applicable law provide.

Under the standard plans, SERVITH owns the copyright in the site, including its source code and design, and you may use the site for your business while your plan is active. If you buy the Source Code Handover option, ownership of the site transfers to you once the handover fee is paid in full. Common code that SERVITH uses across many sites can still be used by SERVITH in other projects, and you can use it in your site without restriction. Unless you ask us not to, we may show the finished site in our portfolio.

Logos, text, images, video and other material you supply remain yours. You confirm that you have the right to use them and are responsible for any claim arising from them. You allow us to use them only to build and run your site.

We run hosted sites on commercial cloud infrastructure and work to restore service quickly when a problem occurs, but we do not guarantee uninterrupted or error-free operation. We are not responsible for outages caused by third-party providers, networks or events outside our control, and to the extent permitted by law we do not compensate for losses caused by service disruptions.

If a managed plan ends without source code handover, your logo, address, images and video are removed from the site, and the site is either taken offline or kept online without your content. We can return the content you supplied on request. If you take the Source Code Handover part-way through a managed plan, the plan ends on the handover date, and hosting fees already paid for the current term are not refunded.

To the maximum extent permitted by law, SERVITH is not liable for indirect, incidental or consequential losses, including lost profits, revenue or data, arising from the website or our services. Our total liability for any claim is limited to the fees you paid us for the service concerned in the 12 months before the claim arose. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

We may update these Terms, and the date at the top of this page shows the current version. Changes do not apply retroactively. For active plans, material changes take effect from your next renewal, and we will tell you by email beforehand.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes are heard by the courts of Ontario. If you are a consumer, this does not remove the protection of mandatory laws where you live.
